BUS303 Week 5 Discussion 1 Protected Classes and Employment Laws

Describe three protected classes and the laws that exist to protect them.

The three protected classes that I will like to discuss would include disabilities, age discrimination, and sex. Individuals with disabilities are protected under The Americans with Disabilities Act (ADA) of 1990. Disabilities are defined as the physical or mental incapacities in human race. When one is discriminated due his/her disability is said to have been discriminated based on disabilities. On the other hand, Age discrimination is when an applicant is basically judged because of their age. The Age Discrimination in Employment Act (ADEA) is put in place to protect applicants over the age of 40. This is prudent since the applicant will not be denied the job, or, hired based on their age. The ā€œTitle VII of the Civil Rights Act prohibits discrimination based on sex, religion, race, color, or national origin in hiring, promoting, firing, setting wages, testing, training, apprenticeship, and other terms and conditions of employment. The Equal Employment Opportunities Commission (EEOC) enforces Title VII.

Explain how the EEOC investigates complaints of discrimination against a protected individual.

The first step that EEOC investigates complaints of discrimination against a protected individual uses would be filing of a complaint. The complainant would file case with EEOC for it to take action. Besides, when a complaint or charge has been filed, the employer or the third party is notified of the suit. At this point, an investigation commences, and a lawsuit begins against the company or organization.

Discuss how employers can prevent and respond to allegations of employment discrimination.

Employers can prevent and respond to allegations of employment discrimination by them practicing professionalism and being clear about their expectations in the work place and ensure they do not display any type of discrimination. The best way to do this is make sure all human resources employees, managers, and all other employees be well trained in what qualifies as discrimination and what their rights are when it comes to filing a complaint. At my current organization, we have yearly mandatory training that sends out a uniformed message to all employees.
