BUS607 Week 2 Discussion 1 Duties Owed

Duty of Care

The requirements of Duty of Care are that employers should take steps to ensure that their workers are: Do not abuse or neglect them, do not use them in a way that is not part of their work duties, and do not put them in danger of harm, or put them at risk of being hurt or injured (Nolan,2018).

Duty of Loyalty

The requirements of the Duty of Loyalty are that employers should take steps to ensure that their workers are: not misusing their position or power, and not misappropriating business property or confidential information (Ruder,2019).

Business Judgement rule

The requirements of the Business Judgement rule are that employers should take steps to ensure that their workers are: not used in a way that is not part of their work duties.

These duties are designed to protect workers from being exploited, neglected, or hurt physically or in any way. It is necessary because employers are making a profit just to use the workers in the business.

Necessity

From my point of view, these duties are necessary because they protect the workers from being abused and neglected. They also protect them by keeping them safe and free from harm and injury. In my opinion, this is not necessary in all cases, for example, you can train your worker to do the task properly, but if there is a problem with safety then you can either hire another worker to teach him/her something properly or simply provide training for him/her. There are always other ways around it instead of neglecting your worker.
